Examples of Recovering Property

These examples are fictional but help to illustrate how these situations happen and what can be done to resolve them.

Undue Influence

An elderly widow named Jane had a substantial estate, including valuable properties and assets. Her distant nephew, David, took advantage of her vulnerability and manipulated her into changing her estate plan, disinheriting other family members and making himself the sole beneficiary. Jane’s daughter, Lisa, sought legal help and filed a lawsuit against David, alleging undue influence. With compelling evidence presented in court, including testimonies from medical professionals and witnesses, the court ruled in favor of Lisa, ordering the recovery of the property and restoring the original estate plan. This case demonstrates how legal action can successfully recover property after proving undue influence.

Unfunded Trust

John created a revocable living trust to manage his assets, but some valuable properties were never transferred into the trust. After John’s passing, his children, Sarah and Michael, realized the oversight and took legal action. With the help of a trust attorney, they presented their case to the court, emphasizing the trust’s original intent and the need to include the properties. The court ruled in their favor, allowing the recovery of the properties and their transfer into the trust, ensuring proper distribution according to John’s wishes. Sarah and Michael successfully secured their rightful inheritance and avoided probate.
